MEMORANDUM & ORDER CERTIFYING QUESTIONS TO THE SUPREME COURT OF OHIO

Pursuant to Rule XVIII of the Rules of Practice of the Supreme Court of Ohio, this Court hereby CERTIFIES to the Supreme Court of Ohio certain unresolved questions of state law. This Court believes these questions “may be determinative of the proceeding” pending before it and that “there is no controlling precedent in the decisions of [the Supreme Court of ' Ohio].” Ohio Sup.Ct.
