Appeal from a judgment of the County Court of Greene County (Fromer, J.), rendered February 28,1984, upon a verdict convicting defendant of the crime of attempted assault in the second degree.

On September 28,1983, defendant was charged in a two-count indictment with attempted assault in the second degree resulting from an altercation with another inmate while incarcerated at Coxsackie Correctional Facility in Greene County.
