— Appeal from a judgment of the County Court of Chemung County (Monroe, J.), rendered September 26, 1980, upon a verdict convicting defendant of the crime of assault in the second degree. Defendant, an inmate at the Elmira Correctional Facility, was involved in an altercation with a correction officer while being escorted from the special housing unit to the package room. As a result, defendant was indicted and convicted of assault in the second degree (Penal Law, § 120.05, subd 3), and was sentenced to a consecutive term of 3Vfc to 7 years. This appeal ensued.
