WYNN, Judge.

On the night of 16 April 1993, the prosecuting witness, hereinafter referred to as Ms. Doe because the identity of the victim is not an issue in this case, was attacked and raped in the bedroom of her home in Onslow County, North Carolina. The evidence in the record on appeal tends to show that the defendant, who was living next door, approached Ms. Doe at her home several days before the rape and introduced himself. During the course of their conversation defendant ascertained that Ms. Doe was at home alone and her husband, who was deployed overseas with a branch of the military…
