Appeal from Jefferson District Court. — Hon. F. M. Hunter, Judge. Action to recover commission for sale of real estate. Opinion states the facts. Trial to a jury. At the conclusion of plaintiff’s testimony, the court directed a verdict for the defendant. Plaintiff appeals.

The plaintiff contends that he entered into an oral contract with the defendant by which the defendant agreed to pay the plaintiff the sum of $170 if the plaintiff would secure for him a party who would exchange property with the defendant at such figure as would be satisfactory to the defendant; that, if the plaintiff procured a purchaser for defendant’s land for cash, on terms satisfactory to the defendant, the defendant would pay the plaintiff $340.
