— This is an action to recover unpaid broker’s commissions claimed to be due under a contract made by the American Surety Company with' an insurance broker, Edward E. Porterfield, Jr., relative to the latter’s procuring, and placing with defendant, the contract or right to furnish any part of the Bond required of the contractor selected to erect the new Missouri State Capitol.
