THIS CAUSE comes before the Court pursuant to Defendant Standard Insurance Company’s (“Defendant”) Motion for Summary Judgment, filed July 17, 2009 [DE 34], Plaintiff Daniel Weiss, MD (“Plaintiff’) responded on August 10, 2009 [DE 41].
