HENDERSON, Judge.

Appellant was convicted of murder in the second degree, and given five years in the penitentiary, and prosecutes this appeal. A number of exceptions were reserved by the appellant during the trial of the case. However, we will notice only two of them. One is to the testimony of Jim Washington, a witness for the State, who testified that Henry Parr, a son of the defendant, went to the place when the deceased fell, after receiving a mortal wound, about 100 feet distant from the place of the shooting, immediately after the shooting, and there said, apart from the defendant, and…
