This is an action of contract based on a foreign judgment. The plaintiff’s motion for sum mary judgment was allowed and the defendant duly excepted. G. L. c. 231, §§ 59, 59B. The case is before us on the defendant’s bill of exceptions.

We set forth the facts as contained in the affidavits accompanying the motion for summary judgment.
