Crawford was found guilty of murder; his motion for a new trial was overruled, and he excepted. It appeared from the evidence that while the defendant was driving his wagon along the highway, the deceased drove up behind in a buggy, whipping his horse and holloaing, and "upon being asked by another person present whether he was drunk, and what was the matter with him, answered, “No, by G-d, I am not drunk; Warren [the defendant] treated me wrong in town.” The defendant and. the deceased quarreled for awhile, but finally desisted; and when they got to a certain point in the…
