1. The defendant appeals from his conviction for arson. The first enumerated error is the overruling of his motion to prohibit the state from calling any witnesses on the ground that in response to his Code Ann. § 27-1403 demand for a list of witnesses "on whose testimony the charge against him is founded” the state gave him a list of 98 witnesses. In answer to his protest, the state checked 36 names from this list as most likely to be used. The state actually called 16 witnesses and bench warrants were out for two other subpoenaed witnesses.
