At a municipal election in the City of Sacramento, the appellant Rhoads was declared by the canvassing officers to have been duly elected a member of the Board of Fire Commissioners. Kirk, who received the next highest number of votes for the same office, instituted proceedings in the County Court to contest the right of this appellant to the office, charging malconduct upon the part of the Board of Judges of Election in counting votes for Rhoads which should not have been so counted, and in omitting to count other votes for the contestant which should have been…
