ERROR TO THE CIRCUIT COURT OF THE UNITED STATES FOR THE DISTRICT OF MASSACHUSETTS. The facts, which involve the validity of indictments for embezzlement. against a clerk of the District Court of the United States and the construction of statutes relating to' the fees, salaries and accounts of clerks of United States courts, are stated in the opinion.

The defendant, the clerk of the District Court of the United States for the District of Massachusetts, was indicted for- the embezzlement of certain moneys of the United States. Separate indictments were found as to moneys received by the clerk in the year's 1906, 1907 and 1908, respectively. They are precisely alike, save for the difference in the years and the. amounts specified. In each, case the Circuit Court sustained a demurrer, as to three counts of the indictment, the second, third and fourth, and the judgments on the demurrers are brought here for review.
