In this case the plaintiff was granted, during vacation by one of the judges of this court, leave to appeal from an order of the trial judge granting the defendant’s motion for a new trial. The case is now submitted on the petition for leave to appeal and the answer thereto together with the briefs of the parties filed with the petition and the answer.
