The action is for fire damage claimed to have been caused by defendant’s locomotive throwing sparks upon a barn located on a farm owned by plaintiff Olsbove as contract vendee and plaintiff Sparling as bis vendor. Defendant bad verdict of a jury and judgment. Tbe facts are fully set out on tbe review of a former trial, reported in 245 Mich. 369.
