At the close of all the evidence introduced upon the trial of this action, the circuit judge sustained a motion of the de fendant for peremptory instructions and dismissed the suit. The plaintiff insists, upon his appeal in error, that the issue of negligence should have been submitted to the jury.
The action was brought against 0. Owen Lane, the proprietor of a garage and automobile repair shop in Portland, to recover damages for personal injuries sustained by the plaintiff while his automobile was in the shop for repairs. Mr. Lane died while the suit was pending and it was revived against…
