Defendant appeals from a judgment convicting him of violating section 288 of the Penal Code (lewd and lascivious acts upon the body of a child under the age of 14 years). Upon a prior trial, the jury had been unable to agree on a verdict.

Facts: Viewing the evidence in the light most favorable to the People, the record shows that over a period of two or three months in the course of a number of visits by the prosecutrix, an 11-year-old girl, with defendant, a 46-year-old artist, who lived a few doors away, defendant had extensive discussions with the child on sex in which he gave her…
