BRIGHT, Circuit Judge.
The Prudential Insurance Company of America (Prudential) filed this declaratory judgment action seeking an interpretation of certain provisions of an “employee benefit plan” under the applicable provisions of the Employee Retirement Income Security Act (ERISA), 29 U.S.C. §§ 1001-1461. The district court 1 determined that Doe was not a “participant” or a “beneficiary”, as those terms are defined by ERISA, and thus did not have standing to sue under the statute.
