The major issue presented by this case is whether due to the erroneous submission of two counts of perjury to the jury, we should reverse defendant-appellant’s conviction on a third count of perjury, and grant him a new trial as to that count.

Defendant was indicted on three counts of perjury on March 24, 1966, by the Honorable Philip Pratt, sitting as a one man grand jury for Oakland County.
