This action was brought to secure the return and cancellation of three promissory notes aggregating the sum of $10,000, executed by plaintiff on the 24th day of May, 1922,' and payable to defendant Louise Eberle. One of said notes was for $2,500, payable 30 days after date; one for $2,500, payable 90 'days after date, and one for $5,000, payable one year after date. The ground on which plaintiff seeks to avoid the notes is that they were without consideration and that the execution thereof was procured by duress.
