On March 12, 1949, Ruth D. Wooley was killed, as the result of a collision between an automobile driven by her and a freight train operated by the Chicago & North Western Railway Company. The accident occurred at the intersection of the main street of Ree Heights, South Dakota, and the tracks of the defendant company. Harrold W. Wooley, husband of decedent, was appointed special administrator of her estate and brought this action seeking to recover damages for death by alleged wrongful act.
