Action by appellee against appellant on a policy of insurance issued by appellant to appellee, to recover $800 for a truck alleged to have been destroyed by fire while insured with appellant company.
It is averred in the complaint in substance that during the time involved, appellee was the owner of a truck and continued to be such owner until it was destroyed by fire; that at the time the policy of insurance was written, there was a mortgage on said truck to secure the purchase price thereof, which mortgage was executed by appellee to the International Harvester Company of America; that the…
