— Judgment, Supreme Court, Bronx County (Richard Lee Price, J.), rendered May 31, 1990, convicting defendant, after a jury trial held in absentia, of criminal sale of a controlled substance in the third degree (Penal Law § 220.39 [1]) and criminal possession of a controlled substance in the third degree (Penal Law § 220.16 [1]), and sentencing him, as a second felony offender, to concurrent indeterminate terms of eight to sixteen years, unanimously reversed, on the law and facts, and the matter is remanded for a new trial.
