DRANGINIS, J.

The defendant, Hall-Brooke Foundation, Inc., appeals from the judgment of the trial court granting the plaintiff Jennie Fitzpatrick1 a new trial pursuant to General Statutes § 52-270.2 On appeal, the *694defendant claims that the court improperly granted the plaintiffs motion for a new trial because (1) it did not have jurisdiction to do so and (2) § 52-270 does not apply in this case. We reverse the judgment of the trial court.
