QUINN, Justice.

The defendant, Kevin Alexander, appeals his conviction for violating section 18-5-302(2), C.R.S.1973 (1978 Repl.Vol. 8), which prohibits a person from knowingly making “a false representation as to the existence of an ownership interest in land which he has as a seller ... and which is relied upon.” 1 The jury found the defendant guilty of this class 5 felony on the basis of his statement to a prospective purchaser that he “owned” a parcel of land when in reality he had merely contracted to purchase the land and had not yet acquired title.
