Error to Kent; Brown, J. Case by H. Chris Jorgensen, as administrator of the estate of Emil Ingmanson, deceased, against the Grand Rapids & Indiana Railway Company for the unlawful killing of plaintiff’s decedent. Judgment for plaintiff. Defendant brings error.

Plaintiff’s intestate was employed by defendant as a fireman upon one of its engines, and on the 17th day of June, 1912, while the train with which he was connected was distributing gravel and other material for the maintenance of defendant’s roadbed and tracks, he received an injury, attributed to defendant’s negligence; from which he died on the following day. The judgment in this action, which was brought because of such alleged negligence and consequential injury, was recovered by plaintiff under the provisions of the Federal employers’ liability act of April 22, 1908 (35 U. S. Stat. 65),…
