This case is before the court on plaintiffs motion to compel the production of a Taking Impact Analysis (TLA.) document pursuant to RUSCC 37(a)(2).1 The TIA was drafted by the Army Corps of Engineers (Corps) in connection with the evaluation of a permit sought by plaintiff pursuant to the Clean Water Act, 33 U.S.C. § 1344 (1988), to develop property owned by plaintiff in the State of Louisiana.
