Appellants were charged, on May 14,1907, in the city court of New Albany, by verified complaint, with the violation of a city ordinance, in that “ on May 13, 1907, said defendants did, within the corporate limits of the city of Now Albany, Indiana, unlawfully remove the carcass of a dead animal, to wit, a horse, from the city of New Albany, said Gus Smith and Rudolph Alies, nor either of them, then and there having a license or contract with said city for the removal of dead animals, and said city having theretofore entered into a contract with the firm of Parad & Buhler for the removal of…
