By the Court, Rhodes, C. J.:

The complaint states that the plaintiff was the owner and in possession of the premises in controversy; and that he and the defendant entered into a contract in writing for the sale of the land by the plaintiff to the defendant. By the contract it appears that the price to be-paid was six hundred dollars—fifty dollars paid in hand, one hundred dollars to be paid on the 1st of August, 1865, and four hundred and fifty dollars on the 1st of April, 1866, “ with a continuance of time of payment, if needed, on" the last mentioned amount, six months;” and that the…
