OPINION

NYE, Chief Justice.

This suit for damages and other relief is predicated upon the terms of a property settlement agreement executed by Dorothy K. Ashcraft, Appellee, and her late, former husband James Buford Ashcraft, III, which was incorporated into their divorce decree. Mrs. Ashcraft filed suit, alleging that the executrix of her former husband’s estate had refused to accept and pay to her claims against his estate which were authorized by the terms of the agreement.
