OPINION AND ORDER

SESSIONS, District Judge.

Colin Bridge has brought suit on behalf of himself and his deceased wife Marie Forest Bridge (“Bridge”), alleging, inter alia, a violation of Vermont’s Consumer Fraud Act, Vt. Stat. Ann. tit. 9, § 2453 (1993) (“CFA”) for the misinterpretation of her Pap smear. The matter was referred to the United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(A) and (B).
