This is an appeal from a judgment of the district court of Carter county in an action for an injunction. The parties occupy the same positions here as in the trial court and will be referred to as plaintiff and defendants. On February 5, 1935, in the case of Miller v. American Bank & Trust Company, 171 Okla. 99, 40 P. (2d) 1074, the action of the trial court in over ruling objections to tlie confirmation of sheriff’s sale of certain lands was affirmed, and petition for rehearing thereon was denied on March 12, 1935.
