EDENFIELD, District Judge.

Before the Court is Defendants’ Motion for Summary Judgment.

I. Background.

This action, brought pursuant to 42 U.S. C. § 1983, arises out of the death of Lindy Boy Easterling. His car left the road and struck a tree while he was being pursued by officers of the City of Glennville Police Department. Plaintiffs are the parents of the deceased. The City of Glennville is a municipal corporation located in Tattnall County, Georgia. Defendant Harry Sands was at all times relevant hereto the Chief of Police of the City of Glennville.
