The plaintiff in error, hereinafter called defendant, was convicted in the district court of Rogers county of manslaughter in the second degree, and his punishment fixed at confinement in the state penitentiary for a term of 2 years and a fine of $500.
This is a companion case to that of Young v. State, 41 Okla. Cr. 226, 271 Pac. 426. Defendant, Young, and two others were charged with the killing of Homer McMillan.
