Plaintiff, as the grantee of a purchaser at sheriff’s sale, endeavored, by a proceeding under the Act of April 20, 1905, P. L. 239, to obtain possession of the property purchased. An answer was filed to his petition, and the jury, on the trial of the issues raised, rendered a verdict for defendants. Subsequently the court in banc entered judgment for plaintiff non obstante veredicto, and this appeal by defendants followed.
