On the eighth day of December, 1871, the following instrument was executed by the parties therein named:

“This agreement, made and entered into this eighth .day of December, A. D. 1S71, between Fletcher Benedict, of the city of Pontiac, in the county of Oakland, in the state of Michigan, and C. W.
