Plaintiff Sykes Laboratory, Inc. (“Sykes”) manufactures and sells a fingernail conditioner which it calls “Sykes’ ‘Perfect Nail.’ ” Defendant Sunshine Beauty Supplies, Inc., (“Sunshine”) markets low cost versions of name-brand beauty products, including the plaintiff’s, under the label, “the GENERIC BRAND.” Defendant Russ Kalvin is the president of Sunshine.
