On 19 April 2006, the Winding Ridge Homeowners Association, Inc., and Theodore Humphrey,.Ill (“plaintiffs”) filed an action against *630defendants Zalman and Devora Joffe (“Joffes”), owners of Lot 1 and a residence located at 106 Mullin Court, Chapel Hill, North Carolina, in the Winding Ridge Subdivision.
