Plaintiff, Precision Pine & Timber, Incorporated (“Precision”), filed this action on February 15, 2002, alleging that defendant United States Forest Service (“Forest Service”) improperly terminated 12 timber sale1 contracts for breach. Precision alleged that the Forest Service was not entitled to the “estimated” damages it asserted against Precision for the alleged breaches as set forth in the contracting officers’ final decisions.
