Lowe, III, J.), entered December 26, 2008, which denied plaintiffs motion for partial summary judgment on its cause of action for breach of contract and for summary judgment dismissing the fourth affirmative defense and the counterclaim, and granted the Ladenburg and Intrater defendants’ motion for summary judgment dismissing the complaint against them, unanimously affirmed, with costs.
