The complainant Marcus Sayre is the owner, and The Marcus Sayre Company is the lessee, of land having a frontage of .about two hundred feet on the west side of the Passaic river in the city of Newark, where they carry on the business of buying and selling mason’s materials. At that point, and for several miles above the city, the tide ebbs and flows in the river, and the river is navigable for vessels of considerable size; consequently the state was the Owner of the bed of the river below ordinary high-water mark; but in pursuance of an…
