The appellee brought this snit against appellants fo recover damages for their infringement upon a *847ferry privilege granted across the Big Sandy river at Turman’s Ferry in Boyd county. Upon a trial before a jury he recovered $1,000.
The question raised by appellants on this appeal are: That the verdict of the jury is excessive. That appellee did not prove a state of case authorizing damages for an infringement of a statutory ferry franchise.
