In April, 1924, the county court of Ballard county, in accordance with the provisions of the Statutes governing the establishment and regulations of ferries, Carroll’s Kentucky Statutes, 1930 Edition, secs. 1800 to 1821, inclusive, granted to the appellee, R. I. Birney, a franchise to operate a ferry across the Ohio river between East Cairo, Ky., and Cairo, Ill.
