This is an action for divorce brought by the husband, James R. Hewitt, against his wife, Irene L. Hewitt. The couple were married August 15, 1924. One child, a daughter, Eleanor Irene Hewitt, was born September 28, 1929, and is now over nine years of age. She resides with the mother, respondent. Libellant finally left his home and separated himself from his wife on December 12, 1937. A libel was filed February 3, 1938, alleging cruel and barbarous treatment and indignities to the person.
