Plaintiff Charles Fonville brings this action against the District of Columbia (“District”) pursuant to the Fifth Amendment of the Constitution and 42 U.S.C. § 1983. Plaintiff alleges that he was deprived of his constitutionally protected property interests when he was demoted from the rank of Commander to Captain in the Metropolitan Police Department (“MPD”) without notice or a hearing.
