MEMORANDUM OPINION

GESELL, District Judge.

These two related cases, which have been consolidated with the consent of all parties, challenge the statutory authorization and constitutionality of regulations of the Department of Health, Education and Welfare (HEW) governing human sterilizations under programs and projects funded by the Department’s Public Health Service and its Social and Rehabilitation Service. 39 Fed.Reg. 4730-34 (1974).
