This suit was brought by appellant, as trustee in bankruptcy of the estate of R. H. Moore individually, and of the Terrell Motor Company, and the Moore-Perry Company, each of which was a partnership composed of R. H. Moore and L. C. Perry; the latter being dead at the time of the institution of the bankruptcy proceedings; The suit was brought against Mrs. Minnie E. Perry, widow and sole beneficiary under the will of Louis C.
