The only matter remaining for decision in this case is the third-party claim of Gau-dette Machinery Movers, Inc. (Gaudette) against third-party defendant, Fireman’s Fund Insurance Companies (Fireman’s Fund). The matter is before the Court on cross motions for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure.
