Henley, J. —
Action by appellee against appellant upon a note, of which the following is a copy:
“$4,995. Brazil, Ind., April 21, 1895. On demand, after date, we, or either of us, promise to pay to the order of Sterling R. Holt, negotiable and payable at the First National Bank of Brazil, Indiana, four thousand nine hundred and ninety-five dollars; with eight per cent, interest and attorneys fees, without any relief whatever from valuation or appraisement laws. The drawers and indorsers, severally, waive presentment for payment, protest, and notice of protest, and non-payment of this note.…
