NICHOLLS, J.

This suit is brought by the plaintiff, as the tutor of a minor, named Will Champion, for damages for personal injuries alleged to have been received by the minor through the fault and negligence of the defendant. His cause of action, as set out in the petition, is: That while in the employ of the said railroad company, and wholly without fault on the said minor’s part, but solely and entirely on account of the gross fault and negligence and carelessness of the said railroad company, its officers, agents, and supervisors, the said minor received painful and…
